This Privacy Policy is intended to cover the various sites and applications through which MySureFit obtains information, including "mini sites" displayed through our third-party website partners and "mini applications" displayed on third-party websites (each a "site" or "application"). MySureFit reserves the right to update the sites, applications and Privacy Policy at any time and without notice. We may modify this Privacy Policy from time to time, and the modified Privacy Policy will be effective upon posting. Please return to this page frequently and check the "Updated" date above to make sure you understand and agree to the latest Privacy Policy. Continued access of this site or application by you will constitute your acceptance of any changes or revisions to the Privacy Policy.
Your use of this site or application signifies your acceptance of and your agreement to the terms of this Privacy Policy. In addition, by your use of this site or application, you are consenting to our use of your information as described in the following sections.
1. DATA SECURITY
MySureFit takes your privacy seriously and has reasonable and appropriate security measures in place to protect against the loss, misuse, disclosure, or alteration of your personally identifiable information.

Where personal or sensitive user data is required to be transferred to a third-party application such as a payment processing application, the MySureFit™ site and application handles the transmission of all such data over an encrypted connection using Secure Socket Layers (SSL) and https: protocols.
3. DATA ACCESS, COLLECTION, USE AND SHARING
MySureFit is the next-generation of on-line shopping using digital fit technology together with outfit visualization on a model, or a person’s selfie to provide a superior shopping experience. The app allows you to take a selfie and upload it to our site. The MySureFit app or site allows for you to share your visualized outfit and/or the MySureFit app with your friends using the contact list on your device.
The app uses a double opt-in model to gain your permission and consent to the use of your contact list, selfie photos and location. The first level of opt-in consent occurs in the MySureFit app during the registration process. The user can approve any or all of the permissions requested at that time. The second level of opt-in consent occurs at the time of use within the app or site.
The MySureFit site or application limits the use of personal and sensitive user data, acquired through or by our site or application, to directly providing and improving the features of our site or application.
None of your data is sold. None of your data is shared with third party sources unless required as part of our user experience (e.g., we share your name and credit card information with our third-party credit card processor to complete your transaction).
This policy covers the MySureFit™ sites and applications through which we access, collect, use and share your personal and sensitive information.
3.1 DATA ACCESS AND COLLECTION

We may use various methods and technologies to access or collect usage information (“Tracking Technologies”). Tracking Technologies may set, change, alter or modify settings or configurations on your device.

The MySureFit site or application limits the use of personal and sensitive user data, acquired through or by our site or application, to directly providing and improving the features of our site or application.
i. Use of Internet Protocol Address
An Internet Protocol (IP) address is a unique number automatically assigned to your computer when it accesses the Internet or another computer network. Web servers and network devices automatically identify your computer by its IP address. We may use your IP address for several reasons including to help diagnose problems with our servers, administer our site or application, help identify you and your shopping cart, compile aggregate information and gather broad demographic information.
ii. Use of Registration Information
We do not require anyone to disclose personal information to merely visit one of our sites or applications. However, our sites and applications may contain special features and privileges for those who do register. The registration areas of our sites and applications require you to supply contact information which may include name, e-mail address, and demographic information, such as your ZIP or postal code, age, or income level. When you provide this information to us, you are no longer anonymous. We may use this information to send you promotional materials from our company. However, users may choose to opt-out of these promotional e-mail messages at any time.
If you choose to sign into our site through another social media site such as Facebook, we will access the data from that site to create your user account on MySureFit™.
iii. Use of Demographic Information
We also collect demographic and profile data that we use to tailor your experience on our sites and application. We may use this data to show you products and content that we think you might be interested in and displaying products and content according to your preferences.
iv. Use of User Submitted/Uploaded Photos
Our sites and applications allow the user to take a series of photographs and upload those to the site for the sole purpose of determining proper fit and visualizing outfits on a person’s own body. These images will only be viewed by the user in our application and site.
v. Use of User Contact List
The sharing features of the MySureFit app function optimally when they have access to the Contact List on your mobile device. The app accesses your contacts to build a selection list of your friends for you to choose from. The contact list is used solely as a means of assisting you in choosing friends. We use the contact information (primarily phone number for texting and link for social share) to pass to our service that creates and sends the appropriate text or social share. None of this information is stored in our database.
vi. Use of Order Information
The contact information provided is used to fulfill orders, as well as to send company information and promotional material to you. You can opt-out or opt-in at any time (See Opt-Out/Opt-In, below.) Your credit card information is used for the sole purpose of processing the transaction for the products and/or services ordered and is not stored in our database.
vii. Use of Information from Online Surveys or Contests
From time to time, we may conduct surveys or conduct contests on our sites or applications. If you decide to participate, you will be required to supply contact and demographic information. MySureFit uses this data to send you information about the company. We may also use the information you submit, including your responses to the survey questions, for the purpose(s) identified to you prior to your participation in the survey.
Furthermore, as we may be conducting certain surveys with our advertisers, sponsors, or other third parties, we may also share the results with them, but in no event will the results personally identify you. We may also use this information to contact you as necessary.
viii. Correct/Update/Delete Personal Information
MySureFit allows you to change, modify or delete your personal information by sending an e-mail requesting such a change to our Member Care Team at care@mysurefit.com.
3.3 DATA SHARING
MySureFit™ is strictly prohibited from selling a user’s personally identifiable and sensitive information that may have been entered into our site or application. As well, we are prohibited from selling information gathered by our site or application unless explicitly granted permission by the user. We may share certain demographic, user and order information with our partners and their third-party applications as described below.
i. Sharing of Demographic Information
Demographic and profile data that we use to tailor your experience at our sites and on our applications may be shared with our partners on an aggregate basis only.
ii. Sharing of User Contact List
Under no circumstances will the site or application share any of the user contact list information with any third party.
iii. Sharing of User Submitted/Uploaded Photos
User images and photos submitted by the user will only be used and viewed by the user across our site and application unless the user chooses to share them with friends. In the event the user decides to share a photo with someone else, the MySureFit™ site and application handles the transmission of all such data over an encrypted connection using SSL and https: protocols.
iv. Sharing of Order Information
The information provided at time of checkout is used to fulfill orders only. The credit card information may be shared with a third-party financial application that handles the credit card transaction. The MySureFit™ site and application handles the transmission of all such data over an encrypted connection using SSL and https: protocols.
3.4 DATA RETENTION
MySureFit retains your data for an indefinite period as long as you are an active user on the MySureFit™ site or application. If you have not logged on to the MySureFit™ site or app in the past three (3) years, MySureFit may archive and delete your data from the MySureFit database.
4. OPT-OUT / OPT-IN
The MySureFit app uses a double opt-in model to gain user permission and consent to use contact lists, photographs and location. The first level of opt-in occurs during the user registration process. The second level of opt-in occurs at the time when the app needs access to the contact list, photos or location.
MySureFit also allows users to opt-out of receiving e-mail from us or our partners. To opt-out, send an e-mail to: care@mysurefit.com specifying whether you wish to opt-out from us, our partners or both.

5. CHILDREN’S PRIVACY STATEMENT
This site or application is directed to teenagers and adults and is not directed to children under the age of 13. MySureFit’s sites and applications are designed to fully comply with the requirements of the Children’s Online Privacy Protection Act of 1998 ("COPPA"). In accordance with COPPA, this site or application is intended only for those who are age 13 or above.
We do not knowingly solicit or collect personally identifiable information from children under the age of 13 on this site or application. MySureFit reserves the right, by law, to send a one-time response to an e-mail sent by a child under the age of 13 if that child sent an e-mail to MySureFit, with or without parental consent, and identifies his or her age. If we receive an e-mail from someone who identifies themselves as being under the age of 13, we will reply to the e-mail and then delete any personally identifiable information from our database. If we discover that we have inadvertently collected or received personally identifiable information from a user under the age of 13, we will take all reasonable measures to delete such information from our records.
6. DISCLAIMER/LINKS TO EXTERNAL SITES
Our sites or applications may contain links to other third-party sites. The privacy and information collection practices of other companies collecting data are not covered by MySureFit’s Privacy Policy. Please be sure to read their privacy policies prior to providing any information on or to that site.
7. PUBLIC DISCLOSURE
The MySureFit™ site and application never publicly disclose any personal and sensitive user data related to financial or payment activities.
8. MERGER, SALE OR BANKRUPTCY
In the event that MySureFit files for bankruptcy or is sold, or any of its products, including sites or applications, are sold or transferred, all lists and data which contain personally identifiable information and data, will be transferred to the new owner and will be subject to the same privacy requirements stipulated in this Privacy Policy.
9. COMPLIANCE WITH LAW
MySureFit reserves the right to access and disclose any personally identifiable or non-personally identifiable information if we in good faith believe that such action is necessary in order to (1) comply with applicable laws, lawful government requests and any orders of the court; (2) protect or defend our legal rights or property, this site or application, or its users; or (3) protect against misuse or unauthorized use of this site or application.
